These Terms of Service (“Terms”) govern your use of joyluxcollections.com and any services offered by Joy Lux Collections (“Joy Lux,” “we,” “us,” or “our”). By using the site, you agree to these Terms. If you do not agree, please do not use the site. Our [Privacy Policy](/privacy-policy/) explains how we collect and handle personal information, and our [Shipping Policy](/shipping-policy/) explains processing, delivery, tracking, insurance, signatures, package issues, and shipping-charge rules.
Website Use
You may use this site only for lawful purposes and in a way that does not interfere with the site’s operation, compromise security, infringe rights, or misrepresent your identity or relationship with Joy Lux.
Product Information and Availability
We work to present accurate descriptions, photographs, measurements, condition details, and availability. Colors and appearance may vary by device. Because many items are pre-owned and may be one-of-a-kind, availability can change without notice. An item is not reserved unless Joy Lux confirms the reservation in writing.
Pricing, Orders, and Payment
Prices and other purchase terms are shown on the applicable product or checkout page, if enabled. We may correct typographical, pricing, availability, or description errors and may cancel or decline an order where permitted by law. Payment processing may be handled by a third-party provider under that provider’s terms and privacy policy.
Payment processing is provided through Stripe. Applicable taxes, order-confirmation details, and checkout terms will be shown at checkout or in the applicable order confirmation when online checkout is enabled.
Shipping, Returns, and Refunds
We ship within the United States. The customer is responsible for shipping charges shown at checkout or otherwise stated on the applicable order. Delivery estimates are estimates only and may be affected by carrier delays, address errors, weather, or events outside our control.
Buyer Returns
A buyer may request a return within 30 days after delivery if the buyer is not satisfied with the purchase. The buyer is responsible for return shipping. Original outbound shipping is generally nonrefundable, except where Joy Lux sent the wrong item or the item was materially misdescribed. The item must be returned in the same condition as received, with the Joy Lux security tag attached and intact, and with included accessories, dust bags, packaging, and other materials. The item must not have been used, altered, repaired, cleaned, stained, exposed to odor, or damaged after delivery. Removing or tampering with the security tag may void the voluntary return privilege, except where applicable law requires otherwise or where the issue concerns arrival damage, authenticity, material misdescription, or another legally protected claim.
Joy Lux will inspect the returned item before issuing any approved refund to the original payment method. A refund may be denied or reduced when the item is returned with post-delivery wear, damage, missing components, a removed or tampered security tag, or another condition change not caused by Joy Lux. If an item arrives damaged, is materially different from its listing, or raises an authenticity concern, the buyer should contact Joy Lux promptly before shipping it back so the matter can be documented and the appropriate shipping or carrier process can be arranged.
Cancellations and Exchanges
Cancellation requests must be submitted before an order has shipped and are not guaranteed until confirmed by Joy Lux. Exchanges are not guaranteed and may be handled as a return and a new purchase. Any item-specific or checkout-specific terms control if they provide additional details.
Consignment Inquiries
Submitting an inquiry does not mean Joy Lux has accepted an item for consignment. Acceptance, authentication review, pricing, listing timing, sale terms, payout, fees, handling of unsold items, and any other consignment terms must be confirmed in a separate written agreement or other written confirmation.
The standard consignment period is 120 days from acceptance unless a different period is confirmed in writing. If an accepted item remains unsold after the standard consignment period, Joy Lux will pay the outbound shipping cost to return it to the consignor. If a consignor requests withdrawal before the end of the consignment period, the consignor is responsible for actual reasonable outbound return shipping, including tracking and insurance or declared-value coverage appropriate to the item.
You represent that you are authorized to submit the item and that the information and photographs you provide are accurate. Do not send an item until Joy Lux provides instructions and confirms the applicable process.
Processing Status and Withdrawal Fee
Joy Lux records consignment milestones in the consignor’s account, including application received, item received, review, authentication in progress, processing confirmed, photography/listing in progress, active consignment, withdrawal requested, return shipping pending, returned, rejected, and sold. If Joy Lux confirms that processing has begun, withdrawing the item may result in a processing fee for work already performed, including authentication coordination, photography, listing preparation, website administration, and related handling. The applicable fee, any actual third-party service cost, and return-shipping responsibility will be disclosed before the item is returned and acknowledged through the application, consignment agreement, account status, or written confirmation. No processing fee applies when Joy Lux rejects the item before processing begins or causes the withdrawal through its own error or decision.
Recorded Consignment Calls
Joy Lux may conduct a recorded video call as part of the consignment process to document condition, ownership representations, item details, approvals, disclosures, and agreed next steps. The call will be recorded only after all participating parties provide explicit consent. Written confirmations and account event records may also be maintained. Recordings will be handled as business records and accessed only for authorized business, customer-service, dispute-resolution, accounting, legal, or compliance purposes.
Intellectual Property
The site and its original content, branding, text, graphics, photographs, design, and software are owned by or licensed to Joy Lux and are protected by applicable intellectual-property laws. You may not copy, modify, distribute, publish, sell, or create derivative works from site content without prior written permission, except for personal, noncommercial use permitted by law.
User Submissions
If you submit text, photographs, or other material, you grant Joy Lux permission to use it as reasonably necessary to review, communicate about, market, and manage the relevant inquiry or consignment relationship, subject to any separate written agreement. You represent that you have the rights needed to submit the material and that it does not violate another person’s rights.
Disclaimers
The site and its content are provided for general information and, except as expressly stated in a written agreement or required by law, are provided on an “as is” and “as available” basis. We do not guarantee that the site will always be uninterrupted, error-free, or free of harmful components.
Nothing in these Terms limits rights or remedies that cannot lawfully be limited.
Limitation of Liability
To the fullest extent permitted by law, Joy Lux and its owners, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the site or services. Any liability limitation applies only to the extent permitted by applicable law.
Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Joy Lux and its owners, employees, contractors, and service providers from claims, losses, liabilities, costs, and expenses arising from your violation of these Terms, misuse of the site, or infringement of another person’s rights.
Governing Law and Disputes
These Terms are governed by the laws of California, USA, without regard to conflict-of-law rules. Any permitted court proceeding will take place in San Diego County, California, unless applicable law requires otherwise.
Changes to These Terms
We may update these Terms from time to time. The revised version will be posted on this page with an updated effective date. Your continued use of the site after an update means you accept the revised Terms.
